Gambling Age Limits and ID Checks
New Zealand enforces strict statutory age minimums across all gambling formats. Unlike many overseas jurisdictions with a uniform 18-year or 21-year threshold, New Zealand law differentiates between commercial casino gaming and community lottery products.
Age limits by gambling activity
| Gambling Activity | Minimum Age | Statutory Basis | Operator Duty |
|---|---|---|---|
| Commercial Casino Gaming | 20 Years | Section 301, Gambling Act 2003 | Mandatory ID check at gaming perimeter; strict liability offence |
| Class 4 Pub Gaming (Pokies) | 18 Years | Section 302, Gambling Act 2003 | Age verification in designated gaming areas of hotels and clubs |
| TAB Sports & Race Wagering | 18 Years | Racing Industry Act 2020 | Account verification before accepting sports or racing bets |
| Instant Kiwi (Scratchcards) | 18 Years | Gambling Act 2003 | Retail verification at lottery point of sale |
| Lotto, Powerball, Strike | No age limit | New Zealand Lotteries Rules | Traditional draw tickets have no statutory minimum, though retailers policy restricts to 18 |
Acceptable Forms of Identification
Under Section 304 of the Act, venue operators may only accept official photo identification proving age. The three valid statutory forms of ID are:
- A valid, unexpired New Zealand or Foreign Passport.
- A valid, unexpired New Zealand Driver Licence.
- A valid Kiwi Access Card (or valid 18+ Hospitality Card) issued by the New Zealand Hospitality Association.
Employee badges, student identity cards, photocopies, or digital photographs stored on smartphones do not satisfy the statutory test.
